        • because CRA lays hands before you. You don't get to touch your tax money.
          • If you don't pay tax the agent has to pay. In the case that the agent deducts it as a cost, CRA would either enforce him/her to pay or you must pay, depending upon the agreement you had.

      • It is not true. It is not 本来就是你的钱 because you did not pay commission, but the seller did. The money is a gift.
        • It's your after tax income, it's the refund from your payment, don't need to pay double tax, unless you like.

            • 不知道你仔细看了上面给的三个讨论么?那部分钱,JJ怎么报是JJ的事,应该报discount,也可以报expense,不计入收入部分,不用交税。买家作为discount,不是收入,更不用计入收入交税。前提是,买家拿到的是自己买房子的返还。

                    • You have an agreement with the seller. The seller has an agreement with the seller's agent. The seller's agent has an agreement with your agent. Each step is indepedent.
                • If you want to avoid paying tax, the correct way to do it is to lower the purchase price of the house by telling the seller's agent that your agent will accept a reduced commission
                  and the seller's agent will need to sign a new agreement with the seller to reduce the overall commission.

        • 关键是经纪不能把它算成业务支出,而只能看成是自己生活支出。回扣实际上就是赠送,用到的应该是自己的税后收入,就像我们用赚到的钱赠送父母兄弟,给朋友送礼一样
    • Simply issue, some people made it complex, some JJ even issued T4A to the clients. JJ claim expense, clients no need to claim income. JJ can't force clients to claim income. If you prefer, you may claim, but don't mislead others.

      • 个人理解,不算你的收入,那经纪就不能把“返还佣金”作为自己的业务支出( 想减少自己的收入,获得 ‘退税’ ),否则,税务局不干了赔本儿的买卖了嘛。
        • JJ claims expense as it is, you don't need to claim income, you see, why tax is complex, not everyone can understand, that's why you need professional accountant who can really understand the rule of tax
